1. AREAS OF APPLICATION AND MODIFICATIONS OF THE TERMS OF SALE
The following terms of sales are applying to all orders made through the www.evinite.com and www.evinite.fr Internet websites.
Evinité reserve himself the possibility to adapt or modify at every moment the following terms of sale. In case of modifications, it will be apply to every order the terms of sale in force the day of the order.
2. OUR OFFER
All products offers, services, clauses of delivery, with the prices showed in Euros (€) or US$ are available in all served countries* (for more information, please contact us), while stocks last. All products sale are described with the highest accuracy. Even so we took all these cautions, some mistakes can still be in the descriptions, prices or quantities. In this case Evinité couldn’t be pursue in this fact and could also cancel the order if we cannot fully satisfy our client. The pictures and images representing the product have only an information value considering the otherness created by the retranscription on the websites.
Except in case of guarantee, all operations existing between Evinité and his clients, uncontested during the 7 days following the delivery, cannot be regard as a complaint. As all food products, the bottles ordered could only be take back in their original packaging unopened. All bottles opened can't be take back. All other demands will be rejected.
3. ORDERS VALIDATION AND ELECTRONIC SIGNATURE
All order form click-signed by the customer settle a irrevocable acceptance which can be question only in the limits settled by the following terms of sale. 4. ORDER
The order can be registered on the site only if you are identified.

All order accept the price and products description available to be sold. The contract is formed when the order is confirmed.

Due to many frauds and to prevent our customers and ourselves of any misuse of credit card, we are now requesting a copy of a official document (ID Card or Passport) for all first order on www.evinite.com. These documents can be send by fax +33 327 966 048 or by email contact@evinite.fr
5. PRICES
All prices are displayed in Euros (€), US dollars (US$), Pounds £ and Yen ￥ and are shown excluding VAT. Taxes, especially French VAT (19,6%) will be add at the end of the checkout process if the delivery is done within the EU 27. In a case of a delivery outside the EU, the billing will be done excluding VAT. All taxes which could be asked as soon as the goods will enter the destination country (local VAT, luxous taxes, customs taxes...) are not included in tre price of the site on could only be claimed to the recipient. 6. PAYMENT AND SECURITY
6.1 PAYMENT WITH CREDIT CARD
The payment is effected on the secured server of our partner, CIC. This involve that no information pass through Evinité websites ( www.evinite.fr and www.evinite.com ). Your credit card payment is so well secured. Your order will be record as soon as we get confirmation from our bank that your payment is done.
6.2 BY BANK CHECK
In this case your order is reserved for 7 days. Beyond this delay, without reception of your check, she will be cancelled. The order will be treated as soon as we get your check.
6.3 SECURITY
The credit card number are crypt by the SSL protocol. The payment is directly made on CIC website. In no case Evinité has no access to these information, and don’t keep them on his servers. That’s why they will be asked at every new transaction on our websites.
6.4 CLAUSE OF PROPERTY RESERVE
The product are belonging to Evinité as long as the whole order amount has been balanced by SARL Evinité.
6.5 LACKING OF PAYMENT
Evinité keeps the right to refuse a delivery or to take an order coming from a customer who hasn’t partially or totally paid for a previous order or with whom Evinité has a payment dispute.
7. MODES AND DELIVERY PERIOD
Evinité commit itself to respect as much as she can the delivery period. For information only, this period is contained between 5 and 15 working days depending of the part of the world where the order is shipped. In most of case, parcels will be delivered against a proof of delivery.
No allowance will be claimed if an article cannot be delivered because of a lack of stocks, an accident, a strike, a natural disaster or any other case independent from our will. The retractation period is 7 days for non-professionals, shipping costs of forwarding are chargeable to the customer.
In the case where the customer will directly return us the goods, he has to contact Evinité before the ship back by handwritten letter (email or post mail). In the case where it is not done, Evinité will be able to refuse the returned goods.
DISPOSAL OF THE « COMPUTERING AND LIBERTY » LAW

9. WHOLE CLAUSE
In the hypothesis that one clause of the present contract will be nul and void by a legislative change or by a justice decision, these will not affect the validity and the respect of the present terms of sale.
10. RESPONSIBILITY AND DISPUTES
In case of dispute, Evinité will first try to arrange an amicable accord with the customer. If this is not possible, the closest justice court from Evinité head office is unique to judge the dispute.
The present terms of sale are subject to the French law.
11. COPYRIGHTS
By the law of the 11th of March 1957, all copying, even partial, from the elements contained on www.evinite.com or www.evinite.fr required first a handwritten agreement from the SARL Evinité.
12. MINORS PROTECTION
All sale to minor under sixteen (16) years old is prohibited by the French law. The customer commits himself to have sixteen (16) years old when the order is achieve, this in accordance with the Public Health Code Book (art. L. 3342-1).
